Terms of Service
These are the terms and conditions which apply to your use of Hot Yoga Charlottesville (HYC) website (the “website”) and the HYC mobile application (the “app”), and the purchase of goods and services from us. Please read these conditions carefully before using this website, the app, or purchasing any goods or services from us. If you do not agree to these conditions, you must not use this website or our app. This Website, the app, and the goods and services displayed on it are provided by Bikram Yoga Charlottesville, LLC (DBA Hot Yoga Charlottesville), “we, “us” and “our”. When we refer to “you” and “your” we mean the user of this website or app, purchaser of goods or user of our services.
Credits
To book a class, your account must include at least one credit. One credit entitles you to attend one class. You can purchase credits via our website or app. Multiple credits can also be purchased as bundles at discounted rates. Price details for credits are available on our website or app and shall be such prices as determined by us. You should be aware that classes and series expire, and future prices are subject to change. Subject to any statutory right of cancellation, payments for credits are non-refundable unless otherwise stated in these conditions.
Memberships
All membership fees are due upon the purchase of the membership or credit. For contract memberships, the first monthly fee is due on the date of purchase and then due on the same day of each subsequent month for the term of the contract purchased. fees must be paid automatically by an electronic fund transfer (“EFT”) from a checking account, debit card, or credit card. By providing your checking account, debit card, or credit card information you are consenting to Hot Yoga Charlottesville automatically withdrawing your fees at the time of payment and as they come due each month. Your fee shall be based on the specific membership. Hot Yoga Charlottesville reserves the right to adjust its membership fees at any time during the term of this agreement.
Freezing/Canceling Your Membership
To cancel your membership, contact Hot Yoga Charlottesville (HYC) by either email or phone. You must provide a minimum of 14 days’ notice. You can temporarily freeze your membership by contacting us with your full name and desired freeze dates, for a one time freeze up to 30 days. You will receive a confirmation via email or phone call after requesting cancellation or freezing. Please reach out if confirmation is not received. We may adjust these terms.

Class Reservations
In order to cancel a reservation in a HYC class and return it to your account, you must unreserve at least 1 hour prior to the class. Once your reservation is canceled, the class credit will be returned to your account to be used at a future date; the credit is not refunded. if you haven’t canceled at least 1 hour before, your scheduled credit will be charged to your series and will not be returned to your account. if you are on an unlimited-membership and do not cancel at least 1 hour before your scheduled class you will receive a $15 late cancellation fee. If you are on an unlimited membership and fail to cancel or late-cancel, you will be charged a $15 no show fee. If you are on a class pack or class credit and do not cancel at least 1 hour before your scheduled class you will lose that class credit. If you are on a class pack or class credit and fail to cancel or late-cancel, you will lose that class credit.
You can cancel your reservation by logging into your account on the Website or the App, and, next to the class you wish to cancel, pressing “unreserve”. Please note, in fairness to all our customers, SPOTS WILL BE RELEASED 4 MINUTES BEFORE CLASS BEGINS. In the event that you do not unreserve at least 1 hour prior to class, or if you do not sign at least 4 minutes before class begins, then HYC shall have the right, without any credit or refund to you, to release your reservation to someone on site for a fee.
Merchandise Returns
If you change your mind about any goods purchased from us, you may return them to HYC within 7 days with your receipt and we will exchange the product for a different size, store credit equivalent to the amount paid for the returned goods, or a full refund to the original payment method provided that the goods are unused, unworn and are not damaged. This does not affect your statutory rights as a consumer.
Lost Articles
Hot Yoga Charlottesville assumes no responsibility for lost or stolen articles. lost and found articles not claimed after 30 days may be donated to charity or thrown away.
Code of Conduct
Hot Yoga Charlottesville is committed to the health, safety, and welfare of all of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. engaging in such activity shall be grounds for immediate termination of this agreement.
Damages
HYC clients shall pay for any damages to HYC property or equipment which results from his/her willful or negligent conduct.
Release, Waiver, and Indemnity Agreement
In consideration of being permitted to participate in Yoga classes, Health Programs, or Workshops (the “Programs”) offered by Bikram Yoga of Charlottesville, LLC (DBA Hot Yoga Charlottesville) I acknowledge and agree to the following:
- I acknowledge the Programs may entail intensive physical activity (conducted in a heated room – approximately 105 degrees Fahrenheit), exertion by me and exposure to other participants and instructors at the business premises (“Premises”). I recognize that such physical activity and exertion may be difficult and strenuous and may cause or aggravate a physical injury, medical condition or death, and that other participants and instructors may have a disease or condition that is infectious and may be transmitted to me resulting in serious sickness or death. I am fully aware of and accept the risks and hazards involved in my participation in the Programs and presence on the Premises.
- I understand that it is my responsibility to consult with a physician prior to and regarding my participating in the Programs and to receive prior approval to participate. I represent and warrant that I am physically fit, and I have no medical condition or injury that would prevent my full participation in the Programs.
- I agree to fully assume all responsibility for any risks, conditions, injuries, sickness, death or damages, known or unknown, which might occur or aggravate as a result of my participation in the Programs.
- I knowingly, voluntarily, and expressly waive any claim I or anyone on my behalf may have against Bikram Yoga of Charlottesville, LLC, its owners, managers, employees and independent contractors and the Premises landlord (“Landlord”), for any injury, condition, sickness, death, damages or loss of personal property that I may incur as a result of being on the Premises or participating in the Programs.
- I, for myself and my heirs and legal representatives release, waive, discharge and covenant not to sue Bikram Yoga of Charlottesville, LLC, its owners, managers, employees and independent contractors or the Landlord for any injury, condition, sickness or death which occurs, is caused by or is aggravated by reason of my presence on the Premises or participation in the Programs.
- I, for myself and my heirs and legal representatives indemnify Bikram Yoga of Charlottesville, LLC, its owners, managers, employees and independent contractors and the Landlord from all liability, claims, indebtedness and expenses (including attorneys’ fees) which are asserted or assessed as a result of or in connection with my being on the Premises or participating in the Programs.
- I agree that it is my continuing responsibility to inform Bikram Yoga of Charlottesville, LLC in writing of any previous and new medical conditions, injuries or surgeries.
- I agree that I will not participate in any Programs if I am sick, not feeling well, have an elevated temperature, or have been exposed to any contagion, including the Coronavirus. I agree that I alone am responsible for my health and safety while I am on the Premises or participating in the Programs and will take all necessary precautions to protect myself as recommended by the Centers for Disease Control.
- I agree that all dues, tuition and registration fees paid by me are non-refundable for any reason, including Bikram Yoga of Charlottesville, LLC’s inability to offer the Programs due to force majeure, to include anything beyond the control of Bikram Yoga of Charlottesville, LLC, acts of God, acts of government authorities, lack of utilities, fire, flood, disease, epidemics, pandemics, war and acts of terrorism.
- I represent that I have disclosed all of my conditions, ailments, injuries and surgeries.
