Release, Waiver and Indemnity Agreement

In consideration of being permitted to participate in Yoga classes, Health Programs, or Workshops (the “Programs”) offered by Bikram Yoga of Charlottesville I acknowledge and agree to the following:. 

1. I acknowledge the Programs may entail intensive physical activity (conducted in a heated room – approximately 105 degrees Fahrenheit), exertion by me and exposure to other participants and instructors at the business premises (“Premises”). I recognize that such physical activity and exertion may be difficult and strenuous and may cause or aggravate a physical injury, medical condition or death, and that other participants and instructors may have a disease or condition that is infectious and may be transmitted to me resulting in serious sickness or death. I am fully aware of and accept the risks and hazards involved in my participation in the Programs and presence on the Premises. 
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participating in the Programs and to receive prior approval to participate. I represent and warrant that I am physically fit, and I have no medical condition or injury that would prevent my full participation in the Programs.
3. I agree to fully assume all responsibility for any risks, conditions, injuries, sickness, death or damages, known or unknown, which might occur or aggravate as a result of my participation in the Programs. 
4.  I knowingly, voluntarily, and expressly waive any claim I or anyone on my behalf may have against Bikram Yoga of Charlottesville, LLC, its owners, managers, employees and independent contractors and the Premises landlord (“Landlord”), for any injury, condition, sickness, death, damages or loss of personal property that I may incur as a result of being on the Premises or participating in the Programs. 
5. I, for myself and my heirs and legal representatives release, waive, discharge and covenant not to sue Bikram Yoga of Charlottesville, LLC, its owners, managers, employees and independent contractors or the Landlord for any injury, condition, sickness or death which occurs, is caused by or is aggravated by reason of my presence on the Premises or participation in the Programs.
6. I, for myself and my heirs and legal representatives indemnify Bikram Yoga of Charlottesville, LLC, its owners, managers, employees and independent contractors and the Landlord from all liability, claims, indebtedness and expenses (including attorneys’ fees) which are asserted or assessed as a result of or in connection with my being on the Premises or participating in the Programs.
7. I agree that it is my continuing responsibility to inform Bikram Yoga of Charlottesville, LLC in writing of any previous and new medical conditions, injuries or surgeries.
8. I agree that I will not participate in any Programs if I am sick, not feeling well, have an elevated temperature, or have been exposed to any contagion, including the Coronavirus.  I agree that I alone am responsible for my health and safety while I am on the Premises or participating in the Programs and will take all necessary precautions to protect myself as recommended by the Centers for Disease Control.  
9. I agree that all dues, tuition and registration fees paid by me are non-refundable for any reason, including Bikram Yoga of Charlottesville, LLC’s inability to offer the Programs due to force majeure, to include anything beyond the control of Bikram Yoga of Charlottesville, LLC, acts of God, acts of government authorities, lack of utilities, fire, flood, disease, epidemics, pandemics, war and acts of terrorism..
